§1. Postanowienia ogólne§1. General provisions

Właścicielem serwisu znajdującego się pod adresem handycraftstudio.pl oraz Usługodawcą jest Aleksander Garbicz, zamieszkały pod adresem: Kraków, ul. Myśliwska 63, prowadzący działalność nierejestrowaną, zwany dalej „Pracownią”. The owner of the handycraftstudio.pl website and the Service Provider is Aleksander Garbicz, residing at: Kraków, ul. Myśliwska 63, conducting an unregistered business, hereinafter referred to as the "Studio".

Niniejszy Regulamin określa zasady: These Regulations define the rules for:

• składania zamówień,placing orders,
• zawierania umów o świadczenie usług krawieckich,concluding contracts for the provision of tailoring services,
• sprzedaży produktów.sale of products.

§2. Rodzaje usług i zawarcie umowy§2. Types of services and conclusion of the contract

Pracownia świadczy usługi: The Studio provides services:

• a) szycia na miarę (na indywidualne zamówienie),a) custom sewing (on individual order),
• b) poprawek krawieckich i upcyclingu (na materiałach powierzonych przez Klienta).b) tailoring alterations and upcycling (on materials provided by the Customer).

1. Poprawki krawieckie
Podstawą wyceny jest cennik dostępny na stronie (ceny orientacyjne „od”). Ostateczna cena ustalana jest: po oględzinach odzieży lub na podstawie zdjęć przesłanych przez Klienta. Zawarcie umowy następuje w momencie akceptacji wyceny przez Klienta. 1. Tailoring alterations
The basis for pricing is the price list available on the website (approximate "starting from" prices). The final price is set: after physical inspection of the clothing or based on photos sent by the Customer. The contract is concluded upon the Customer's acceptance of the quote.

2. Szycie na miarę
Zawarcie umowy następuje po: akceptacji indywidualnej wyceny oraz wpłacie zadatku. 2. Custom sewing
The contract is concluded after: acceptance of the individual quote and payment of the deposit.

§3. Dostarczanie odzieży§3. Delivery of clothing

Klient dostarcza odzież do Pracowni na własny koszt. Pracownia nie ponosi odpowiedzialności za uszkodzenia lub zagubienie przesyłki przez przewoźnika przed jej doręczeniem do Pracowni. The Customer delivers the clothing to the Studio at their own expense. The Studio is not liable for damage or loss of the shipment by the carrier before delivery to the Studio.

Po otrzymaniu odzieży Pracownia dokonuje oględzin. W przypadku wykrycia uszkodzeń, plam, zużycia materiału, Pracownia może je udokumentować (np. zdjęciowo) i poinformować Klienta. Upon receipt of the clothing, the Studio conducts an inspection. In case of detecting damage, stains, or material wear, the Studio may document them (e.g., with photos) and inform the Customer.

W przypadku braku akceptacji nowej wyceny po oględzinach – odzież odsyłana jest na koszt Klienta. In case of non-acceptance of a new quote after inspection – the clothing is returned at the Customer's expense.

§4. Płatności i wydanie rzeczy§4. Payments and release of goods

Po wykonaniu usługi Klient zostaje poinformowany o zakończeniu prac i kwocie do zapłaty (usługa + wysyłka). Wysyłka następuje po zaksięgowaniu płatności. After performing the service, the Customer is informed about the completion of works and the amount to be paid (service + shipping). Shipping takes place after the payment is credited.

Do czasu uregulowania należności Pracownia może wstrzymać wydanie rzeczy, o ile przepisy prawa nie stanowią inaczej. Until the amount due is settled, the Studio may withhold the release of the goods, unless otherwise provided by law.

§5. Nieodebrane rzeczy§5. Uncollected items

W przypadku braku zapłaty lub odbioru w terminie 30 dni od powiadomienia, Pracownia może naliczyć opłatę za przechowywanie w wysokości odpowiadającej rzeczywistym kosztom, nie wyższą niż 2 zł za dzień. Przed naliczaniem opłat Klient zostanie dodatkowo wezwany do odbioru. In case of non-payment or non-collection within 30 days of notification, the Studio may charge a storage fee corresponding to actual costs, not higher than 2 PLN per day. Before charging fees, the Customer will be additionally requested to collect.

W przypadku długotrwałego braku kontaktu Pracownia może podjąć działania przewidziane przepisami prawa, w szczególności dochodzenie należności lub przekazanie rzeczy do depozytu. In the event of a long-term lack of contact, the Studio may take actions provided for by law, in particular debt collection or transferring the items to a deposit.

§6. Dostawa i odbiór§6. Delivery and collection

Dostępne formy odbioru: Available collection methods:

• przesyłka kurierska / paczkomatycourier delivery / parcel lockers
• odbiór osobisty (po wcześniejszym umówieniu)personal collection (by prior arrangement)

Koszt dostawy pokrywa Klient. W przypadku odbioru osobistego dopuszczalna jest płatność gotówką (po wcześniejszym uzgodnieniu). The delivery cost is covered by the Customer. For personal collection, cash payment is acceptable (by prior arrangement).

§7. Przejście ryzyka§7. Transfer of risk

W przypadku Klienta będącego Konsumentem ryzyko utraty lub uszkodzenia rzeczy przechodzi na Klienta z chwilą jej odbioru. In the case of a Customer who is a Consumer, the risk of loss or damage to the goods passes to the Customer upon their collection.

§8. Prawo odstąpienia od umowy§8. Right of withdrawal

Klientowi nie przysługuje prawo odstąpienia od umowy w przypadku produktów wykonywanych na indywidualne zamówienie (szycie na miarę). Prawo odstąpienia przysługuje w przypadku produktów gotowych (14 dni). The Customer does not have the right to withdraw from the contract for custom-made products (made-to-measure sewing). The right of withdrawal applies to ready-made products (14 days).

W przypadku usług: jeśli usługa została w pełni wykonana za zgodą Klienta, prawo odstąpienia nie przysługuje. In the case of services: if the service has been fully performed with the Customer's consent, the right of withdrawal does not apply.

§9. Reklamacje§9. Complaints

Klient ma prawo do złożenia reklamacji usług lub produktów. The Customer has the right to file a complaint about services or products.

Reklamacja powinna zawierać dane Klienta, opis problemu i żądanie. Reklamacje rozpatrywane są w terminie do 14 dni. The complaint should include the Customer's details, description of the problem, and demand. Complaints are processed within 14 days.

§10. Dokumentowanie sprzedaży§10. Documenting sales

Pracownia prowadzi ewidencję sprzedaży zgodnie z przepisami dla działalności nierejestrowanej. Do każdego zamówienia wystawiany jest dowód sprzedaży lub rachunek. The Studio keeps sales records in accordance with the regulations for unregistered business. A proof of sale or receipt is issued for each order.

Na żądanie Klienta wystawiana jest faktura bez VAT (do 3 miesięcy). Upon the Customer's request, a VAT-exempt invoice is issued (up to 3 months).

Podanie danych jest dobrowolne, ale niezbędne do realizacji zamówienia.Providing data is voluntary but necessary to process the order.

4. Odbiorcy danych4. Data recipients

Dane mogą być przekazywane: firmom kurierskim, operatorom płatności, biuru rachunkowemu.Data may be transferred to: courier companies, payment operators, accounting office.

5. Okres przechowywania5. Retention period

Dane przechowywane są przez czas realizacji umowy oraz wymagany przepisami (do 5 lat).Data is stored for the duration of the contract execution and as required by law (up to 5 years).

6. Prawa użytkownika6. User rights

Masz prawo do: dostępu do danych, ich poprawiania, usunięcia, ograniczenia przetwarzania. Masz również prawo do złożenia skargi do Prezesa UODO.You have the right to: access data, rectify it, delete it, restrict processing. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO).

Dane nie są wykorzystywane do profilowania.The data is not used for profiling.
